Data Controller

Owner and Data Controller: Ignacio García Taboada.
Tax Identification Number (NIF): 76429705S.
Address: Calle San Lorenzo, 27, 4.º B, 29001, Málaga.
Email: ignacio@garciataboada.es.
Phone: +34 670 853 386.
3. Purpose of Processing
Personal data provided to the firm—whether through its contact channels or during the course of a professional relationship—will be processed, as applicable, for the following purposes:

Responding to inquiries, requests for information, and contact requests.
Managing pre-contractual steps requested by the data subject.
Providing the contracted legal services and managing the professional relationship.
Handling invoicing, the collection of professional fees, and administrative, accounting, and tax obligations arising from the provision of services. Handling claims and exercising or defending the firm’s legitimate rights and interests.
Complying with applicable legal obligations.
The data requested must be adequate, relevant, and limited to what is necessary for each specific purpose. Failure to provide the data required to process a request or deliver a service may prevent it from being carried out.

4. Legal Basis for Processing
Depending on the specific purpose, the legal bases for processing are as follows:

Pre-contractual measures and contractual relationship: for handling requests to engage legal services, preparing the engagement, and executing the contracted services.
Compliance with legal obligations: for fulfilling tax, accounting, and other legal obligations applicable to the firm.
Legitimate interest: for addressing general inquiries and claims, managing the collection of outstanding amounts, and formulating, exercising, or defending claims—subject to an assessment of the necessity of such processing and its impact on the rights and freedoms of the individuals concerned.
Consent: when requested for a specific purpose that requires it. Consent may be withdrawn at any time, without affecting the lawfulness of any processing carried out prior to such withdrawal.
When the provision of legal services requires the processing of special categories of personal data, the applicable legal basis shall be supplemented by a legal exception permitting such processing—specifically, when necessary for the formulation, exercise, or defense of legal claims. Data concerning criminal convictions and offenses shall be processed only in the circumstances and with the safeguards provided for by law.

5. Recipients
Personal data may be disclosed to public administrations and competent authorities where a legal obligation exists.

When necessary for the execution of a professional engagement—and provided there is a valid legal basis—data may be disclosed to judicial bodies, procedural representatives (*procuradores*), expert witnesses, or other professionals involved in the matter, in compliance with the duty of confidentiality and professional privilege. Furthermore, service providers who need to process the data on behalf of the firm in order to provide their services may access such data, subject to the appropriate safeguards and data processing agreements.

Except in cases explicitly permitted by law, the consent of the data subject will be requested whenever it is necessary to share their data with other recipients.

6. Data Retention
Data will be retained for as long as necessary to fulfill the purpose for which it was collected and to comply with applicable legal obligations.

Data relating to inquiries will be retained for the time necessary to address them and, where applicable, for the periods required to address potential liabilities. If an inquiry leads to a professional engagement, the data will be incorporated into the management of that relationship.

Data related to legal services will be retained for the duration of the professional relationship and, once it has concluded, for the legally mandated retention periods and the limitation periods for any liabilities that may arise from that relationship.

When data is due for deletion, it will be placed in a “blocked” state, in accordance with legal requirements. Blocking prevents any processing—including viewing—of the data, except when it must be made available to judges, courts, the Public Prosecutor’s Office, or competent public authorities (such as data protection authorities) for the purpose of addressing potential liabilities arising from the processing, and only for the duration of the applicable limitation periods. Once these periods have expired, the data will be destroyed.

7. Security and Confidentiality
The data controller must implement appropriate technical and organizational measures to ensure a level of security commensurate with the risk. This assessment should take into account the state of the art, the costs of implementation, the nature, scope, context, and purposes of the processing, as well as the risks to the rights and freedoms of individuals.

Access to data must be restricted to those who require it to perform their duties, and such individuals must be bound by corresponding confidentiality obligations. When third-party providers process data on behalf of the firm, the necessary contractual safeguards must be established.

Security measures cannot guarantee the absolute absence of incidents. This does not, however, exempt the data controller from their obligations or liabilities under applicable law. 8. Rights of Data Subjects
In accordance with the terms and requirements established by applicable law, you may exercise the following rights:

Access: to know whether your personal data is being processed and to obtain information regarding such processing, as well as a copy of the data.
Rectification: to request the correction of inaccurate data or the completion of incomplete data.
Erasure: to request the deletion of data when the legal requirements are met and there is no justification for its continued retention.
Restriction of processing: to request that the processing of your data be restricted in the circumstances provided for by law.
Objection: to object, on grounds relating to your particular situation, to processing based on legitimate interests. In such cases, the processing of the data will cease, unless there are compelling legitimate grounds that override your interests, rights, and freedoms, or if the data is required for the establishment, exercise, or defense of legal claims.
Portability: to receive the data you have provided in a structured, commonly used, and machine-readable format, and to request its transmission to another data controller, provided that the processing is based on consent or a contract and is carried out by automated means, in accordance with the terms provided for by law.
Withdrawal of consent: to withdraw your consent at any time, without affecting the lawfulness of any processing that took place prior to such withdrawal.
You may submit your request to ignacio@garciataboada.es or to Ignacio García Taboada, Calle San Lorenzo, 27, 4.º B, 29001, Málaga, specifying the right you wish to exercise and providing the information necessary to process your request.

You are not required to automatically provide a copy of your identification document. Should there be reasonable doubts regarding your identity, you may be asked to provide the additional information necessary to verify it.

The exercise of these rights is free of charge, subject to the exceptions provided for by law in cases where requests are manifestly unfounded or excessive. As a general rule, requests will be addressed within one month of receipt. This period may be extended by an additional two months in cases provided for by the applicable regulations; you will be informed of any such extension and the reasons for it within the initial one-month period.

9. Protection of rights
If you believe that the processing of your personal data infringes upon applicable regulations, you may file a complaint with the Spanish Data Protection Agency (AEPD).

Information regarding the procedures and channels for filing a complaint can be found on their electronic office (website): https://www.aepd.es.

Filing a complaint with the AEPD is free of charge and does not require the assistance of a lawyer or legal representative.

10. Updates
This policy may be updated to reflect regulatory changes or modifications to the firm’s data processing activities. The updated version will be made available to the relevant individuals, and, where appropriate, they will be informed of significant changes before any new purposes are implemented or other modifications are made that require additional information or consent.

1.
